Participation
and Conduct
I will not participate in group fitness circuit classes
if I am under 14 and not use resistance or weights equipment
if I am under 16 unless supervised by a PCYC Fitness instructor.
I will comply with signage indicating equipment usage.
I will comply with any direction made by a PCYC Fitness
instructor relating to my health and safety, and to the
health and safety of other PCYC Fitness members.
Authorisation
I authorise PCYC to obtain all necessary medical treatment,
including any anaesthetic or surgical attention, which
may be prescribed by an appropriately qualified medical
practitioner, which may be required by me (or my child
or ward) while using the facilities or in the premises
of PCYC Fitness or PCYC or whilst in the care, control
or custody of PCYC or PCYC Fitness. I undertake to pay
the cost of any such treatment, including any costs incurred
by PCYC or PCYC Fitness, including ambulance fees.
I authorise PCYC to exercise all reasonable control necessary
in the circumstances over me(or my child or ward) or over
my (or my child’s or ward’s) behaviour whilst
in the care, control or custody of PCYC.
I authorise PCYC and PCYC Fitness to undertake Police
checks on me. I acknowledge that it is a condition of
my membership that I submit to a police check if PCYC
requires a check to be completed. I acknowledge that initial
and continuing membership are subject to any decision
by PCYC or PCYC Fitness, at its absolute discretion, based
on such Police checks (if undertaken) and recommendations.
I authorise PCYC to use my (or my child’s or ward’s)
Digital Resource for promotional purposes. I assign any
and all rights, title and interest in the digital resource
to which I(or my child or ward) may be entitled in law
to PCYC or PCYC Fitness, and agree to make no claim for
compensation for the use of the digital resource.
I am fully aware of the range of activities run by PCYC
and, in particular, PCYC Fitness, and consent to my (or
my child’s or ward’s) participation in any
activities run by PCYC, PCYC Fitness, or its agents.
Code of Conduct & Rules
Members are committed to the mission of PCYC to provide
recreational activities including sports, arts and life
skills that offer young people the chance to lead and
enjoy a good life. In participating in any PCYC program
or activity, members agree to:
Respect the rights and dignity of others
– respect the rights of all members and participants.
Not abuse or harass others – do
not abuse or harass other members with actions or words,
place them in danger, treat them in a discriminatory way,
or take advantage of them.
Respect privacy – respect the privacy
of other members.
Safety for all – help us provide
a safe environment and safe activities. If things are
broken, let us know.
Report harm or abuse – report problems
or behaviour that put yourself or others at risk of harm
or abuse.
A drug, alcohol and smoke free PCYC –
no prohibited drugs, stimulants, steroids or doping for
physical performance will be tolerated.
Follow PCYC rules and policies
In addition to the basic PCYC Code of Conduct, members
of PCYC Fitness agree to:
Be suitably dressed at all times –
a minimum standard of shorts, skirts or long pants, and
shirt or t-shirt, or tracksuit, and covered shoes. Swimwear,
thongs, work-boots, or dirty clothing will not be tolerated.
Maintain hygiene – members must
use deodorant prior to participation, and must use a towel
to manage perspiration. A towel must be placedon all equipment
prior to use.
Use equipment properly – signage/instructions
for equipment must be followed, care taken not to damage
equipment, and reports be provided where equipment appears
faulty. Weights must be returned to stacks. There may
be time limits on equipment during peak periods.
Be punctual – be present at the scheduled start
of a class: instructors have the right not to allow you
to start or enter the room if you are late.
Terms & Conditions
Membership in PCYC Fitness is offered and accepted under
the following terms, conditions, fees and charges:
General Conditions
Membership is conditional upon completion and submission
of a pre-exercise questionnaire and attendance at a pre-exercise
meeting with PCYC Fitness Staff, and may be declined based
on that questionnaire or that meeting.
Membership cards must be produced on each visit. Where
a membership card cannot be produced, a casual visit fee
will be charged. The casual visit fee is as is provided
in the Schedule of Fees current at the time the replacement
card fee is due and payable.
A replacement card fee will be charged where a membership
card is lost. The replacement card fee is as is provided
in the Schedule of Fees current at the time the replacement
card fee is due and payable. Members of PCYC Fitness may
visit and participate in activities at other PCYC Fitness
locations subject to any additional fees to normal membership
charged by that location for participation.
PCYC may provide some facilities, services or privileges
free of charge. PCYC reserves the right to start charging
for these services, even if they were initially provided
to you free of charge.
Membership may be terminated by PCYC where there is a
breach of these terms or conditions, where there is a
breach of the Code of Conduct or Rules, where fees are
not paid, or where there is a recommendation against continued
membership by the NSW Police Force.
Service of a notice of suspension of membership, termination
of membership or request for fee payment will be served
sufficiently where it is delivered to the member in person
or delivered by post or courier to the address provided
in this Membership Agreement or delivered by email to
the email address provided in this Membership Agreement.
We reserve the right to change Terms and Conditions of
Membership, hours of operation, services offered, and
all fees and charges any time, at our sole discretion
and without prior notice to you. Membership fees for the
first Term of membership will not be subject to change.
PCYC is not responsible for the security of personal property
brought by a member to our facilities.
Injury during participation in a PCYC gym or fitness activity
must be reported immediately to staff.
Equipment that you consider faulty must be reported immediately
to staff.
Child-minding services may be available at a PCYC Fitness
location. Not all PCYC Fitness locations provide child
minding services and a prospective member should not assume
the availability of such a service. A separate schedule
of terms and conditions for accessing child minding is
available at the PCYC Fitness website or at any PCYC Fitness
location providing such a service and use of such a service
is based on those terms and conditions.
Membership Fees
There is a once off joining fee, which includes PCYC Club
membership. , This fee is not refundable. Members who
pay membership fees for the minimum term in full do not
need to pay a joining fee.
Membership fees will vary according to:
1.1.1. The Term of the agreement
1.1.2. The level of membership, as determined by inclusion
of aerobics and cycling classes
1.1.3. Whether Membership provides for participation during
all periods of usage or off-peak only
1.1.4. Whether personal fitness assessments and personal
training sessions are included
1.1.5. Whether the payment is paid in full at commencement
On becoming a Member, a person agrees to participate and
make payments for the Term unless notice is provided pursuant
to the cancellation of Membership provisions below. Payments
for the Term are owed to PCYC irrespective of the level
of participation by the Member during the Term.
Payment of membership fees for the Term may be paid in
full or by fortnightly direct debit from a nominated bank
or credit union account.
Fortnightly debit of payments will continue to be charged
after the Term expires until such time as PCYC is advised
in writing of the decision of the member to withdraw from
membership, and will continue to be deducted until 30
days after such notice is received.
Where a payment is not received, membership and participation
may be suspended, and failure to pay fees owed may result
in cancellation.
You accept full responsibility and liability for payment
of fees for the minor whose membership form you sign and
will provide for automatic debits from your own bank or
credit union account.
Where an automatic debit is declined, a debit services
fee will be charged. The debit services fee is as is provided
in the Schedule of Fees current at the time the replacement
card fee is due and payable.
Fees in place from time to time are set out in the fee
schedule available at each PCYC Fitness location. The
Fee Schedule in place at the time membership is sought
forms part of this membership agreement.
PCYC uses the services of a debit payment services company
‘Debitz’ (its agent) to process automatic
debit payments. The member acknowledges that information
in this agreement will be provided to Debitz to facilitate
payment processing, and that Debitz staff may contact
the member directly where payment processing issues arise.
Cancellation or Transfer of
Membership
The Membership Card may only be used by the Member,and
is not assignable or transferable toanyanother person,
including family members.
We allow a ‘cooling off’ period of 7 days
from the date you sign this agreement. If you withdraw
during the cooling off period, your payments will be refunded
after deducting the cost of any services or participation
during the cooling off period in addition to the joining
fee. An administrative fee will also be deducted. The
administration fee is as is provided in the Schedule of
Fees current at the time the replacement card fee is due
and payable.Any notice to withdraw during the cooling
off period must be in writing.
Where a member wishes to cancel membership outside the
cooling off period, a cancellation fee will be charged
The cancellation fee is as is provided in the Schedule
of Fees current at the time the replacement card fee is
due and payable.
Sickness or Incapacity
If, by reason of permanent physical incapacity verifiable
by a medical certificate from a qualified physician, you
are unable to participate in PCYC gym or fitness activities,
PCYC will provide a refund for the unused portion of the
Term subject only to an administrative fee.
If, by reason of temporary physical incapacity verifiable
by a medical certificate from a qualified physician, you
becomes temporarily unable to participate, we will put
in place a Freeze on payments for the period specified
by the medical certificate up to a maximum period of six
(6) months. Payments will be charged and the term recommence
after the date specified in the medical certificate or
at six months from the time the freeze commenced.
Member elected freezing of Membership
You may request a freeze period during which participation
and payments are suspended. Such a suspension must be
for a minimum period on each occasion of four (4) weeks,
and the total number of weeks allowed for any such suspensions
during the Term is twelve (12) weeks. The end date of
the Term will be extended by the period of any such suspensions.
A request for a Freeze must be made to PCYC in writing
on an official PCYC form, and the Membership Card must
be surrendered during the period.
If you become pregnant, a Freeze period of up to 12 months
may be requested.
A Freeze administration fee will be charged where a freeze
period is in place except for those members who have paid
membership for the term in full or for freeze periods
relating to pregnancy. The Freeze administration fee is
as is provided in the Schedule of Fees current at the
time the replacement card fee is due and payable.
A freeze period cannot be backdated and commences only
from the date the official form is accepted by PCYC or
a future date nominated by you. Automatic debits of your
Membership Fee will commence automatically at the end
of the approved Freeze period. |
